Article 1Subject matter主题

This Directive laysdown re for the design and manufacture of productsreferred to in Article 2(1) and rules on their free movement in theUnion.

Article 2Scope范围

1. This Directiveshall apply to the following products:

本指令应适用如下产品

(a) recreationalcraft and partly completed recreational craft;

娱乐船艇及部分完成的娱乐船艇

(b) personalwatercraft and partly completed personal watercraft;

个人船艇和部分完成的个人船艇

(c) componentslisted in Annex II when placed on the Union market separately,hereinafter referred to as ‘components’;

附录II列明的部件单独投放联盟市场时，以下简称部件

(d) propulsionengines which are installed or specifically intended forinstallation on or in watercraft;

安装或专门用于安装在船舶上或船艇内的推进发动机;

(e) propulsionengines installed on or in watercraft that are subject to a majorengine modification;

安装或者安装在需要对发动机进行重大改造的船舶上的推进发动机;

(f) watercraft thatare subject to major craft conversion.

受主要船舶改装影响的船艇

2. This Directiveshall not apply to the following products:本指令不适用如下产品

(a) with regard tothe design and construction re set out in Part A of AnnexI:

关于附件I-A部分所列的设计和建造要求

(i) watercraftintended solely for racing, including rowing racing boats andtraining rowing boats, labelled as such by themanufacturer;

专用于竞赛的艇只，包括划艇竞赛艇及训练划艇，并由制造商贴上该类标签;

(ii) canoes andkayaks designed to be propelled solely by human power, gondolas andpedalos;

设计完全是由人力、贡多拉和脚踏船推动的独木舟和皮划艇;

(iii) surfboardsdesigned solely to be propelled by wind and to be operated by aperson or persons standing;

只供风力推动及由站立人士操作的冲浪板;

(iv)surfboards; 冲浪板

(v) originalhistorical watercraft and individual replicas thereof designedbefore 1950, built predominantly with the original materials andlabelled as such by the manufacturer;

在1950年以前设计的原始历史船只及其个别复制品，主要以原始材料建造，并由制造商贴上标签;

(vi) experimentalwatercraft, provided that they are not placed on the Unionmarket;

试验船舶，但不得在联盟市场出售;

(vii) watercraftbuilt for own use, provided that they are not subse placedon the Union market during a period of five years from the puttinginto service of the watercraft;

为自用而建造的船只，但该等船只投入服务后五年内，其后并没有在联盟市场出售;

(viii) watercraftspecifically intended to be crewed and to carry passengers forcommercial purposes, without prejudice to paragraph 3, regardlessof the number of passengers;

(ix)submersibles; 潜水艇

(x) air cushionvehicles; 气垫车辆

(xi)hydrofoils; 水翼船

(xii) externalcombustion steam powered watercraft, fuelled by coal, coke, wood,oil or gas;

以煤、焦炭、木材、石油或天然气为燃料的蒸汽动力船舶;

(xiii) amphibiousvehicles, i.e. wheeled or track-laying motor vehicles, which areable to operate both on water and on solid land;

水陆两用车辆，即轮式或铺轨式机动车辆，既能在水上行驶，又能在陆地上行驶;

(b) with regard toexhaust emission re set out in Part B of AnnexI:

关于附件I -B部分所列废气排放要求:

(i) propulsionengines installed or specifically intended for installation on thefollowing products: 安装或专门用于下列产品上的推进发动机:

— watercraftintended solely for racing and labelled as such by themanufacturer;

只供竞赛用的船只，并由制造商贴上该等标签;

— experimentalwatercraft, provided that they are not placed on the Unionmarket;

— watercraftspecifically intended to be crewed and to carry passengers forcommercial purposes, without prejudice to paragraph 3, regardlessof the number of passengers;

— submersibles; 潜水艇

— air cushionvehicles; 气垫车辆

— hydrofoils; 水翼船

— amphibiousvehicles, i.e. wheeled or track-laying motor vehicles, which areable to operate both on water and on solid land;水陆两用车辆，即轮式或铺轨式机动车辆，既能在水上行驶，又能在陆地上行驶;

(ii) original andindividual replicas of historical propulsion engines, which arebased on a pre-1950 design, not produced in series and fitted onwatercraft referred to in points (v) or (vii) of point(a);

以1950年以前的设计为基础的历史推进发动机的原始和个别复制品，不是按系列生产，而是安装在(v)点或(vii)点(a)所提述的游艇上;

(iii) propulsionengines built for own use provided that they are not subseplaced on the Union market during a period of five years from theputting into service of the watercraft;

自用的推进式发动机，但该等发动机在该船舶投入使用后五年内不得在联盟市场上出售;

(c) with regard tonoise emission re referred to in Part C of AnnexI:

关于附件一C部分所指的噪音排放规定:

(i) all watercraftreferred to in point (b);

(b)点所提述的所有船只;

(ii) watercraftbuilt for own use, provided that they are notsubse placed onthe Union market during a period of five years from the puttinginto service of the watercraft.

(ii)为自用而建造的船只，但该等船只其后并非在该等船只投入服务后的五年内投放联盟市场。

3. The fact thatthe same watercraft could also be used for charter or for sportsand leisure training shall not prevent it being covered by thisDirective when it is placed on the Union market for recreationalpurposes.

同一艘船只亦可用于租船或进行体育及休闲训练，但该等船只在投放联盟市场作娱乐用途时，并不妨碍本指令涵盖该等船只。

Article 4 Essential re 基本要求

1. The productsreferred to in Article 2(1) may be made available or put intoservice only if they do not endanger the health and safety ofpersons, property or the environment when correctly maintained andused in accordance with their intended purpose, and only on thecondition that they meet the applicable essential re setout in Annex I.

2(1)条款所称产品可提供或投入服务只有在他们不危及人的健康和安全,财产或环境时,正确维护和使用按照他们的目的,前提是他们满足适用的基本要求在附件I列出。

2. Member Statesshall ensure that the products referred to in Article 2(1) are notmade available on the market or put into service unless they complywith the re of paragraph 1.

各会员国应确保第2(1)条所述的产品，除非符合第1款的要求，否则不得投放市场或投入服务。
